“BEST Promotion and Licences Discounts"

1. General

These terms and conditions (“Terms and Conditions”) set out the basis on which you can participate in the Bitpanda BEST Promotion and Blockpit Licences Discounts (all together “Promotion”) organised, in cooperation with Blockpit AG, by Bitpanda GmbH (Stella-Klein-Löw Weg 17, A-1020 Vienna) ("Bitpanda") 

By participating in the Promotion you confirm and accept these Terms. The Bitpanda GmbH terms and conditions (https://www.bitpanda.com/en/legal/bitpanda-general-terms-conditions) and Bitpanda Group terms and conditions (https://www.bitpanda.com/en/legal/bitpanda-group-general-terms-conditions)  apply and form an integral part of these Terms. Please note that the German versions of the Bitpanda GmbH terms and conditions and Bitpanda Group terms and conditions are the prevailing versions. 

2. Promotion Period and Eligibility

The Promotion starts on 9 May, 2023 at 00:00 CET (“Start Date”). The closing date for entries is 23 May, 2023, at 23:59 CET (“Closing Date”) - (“Promotion Period”).

3. How to Enter: BEST 

To participate you (“Participant”) have to sign up to Blockpit via individual Bitpanda link during the Promotion Period and purchase a Blockpit Licence. This Promotion also applies to users that purchase a Blockpit licence and that signed up in past promotions.

Requirements for participation in the Promotion

3.1 Eligibility: 

Entry is open to fully verified and registered Bitpanda users (“Bitpanda Client”) who 

(a) have their country of residence in Germany, Austria, Switzerland, Spain or France 

(b) meet all the requirements described in this section, 

(c) purchase a Blockpit licence during the Promotion Period

(d) register to Blockpit via the personal Bitpanda Link

(e) accept these Terms and Conditions.

Natural or legal persons performing market making services or any similar services are not eligible to enter the Promotion. 

Bitpanda Technology Services users are not eligible to participate in the Promotion. 

Bitpanda may amend and/or call off the Promotion as described herein and you do not have any legal claim against Bitpanda arising out of or in connection with this Promotion.

Raffle Drawings and Prize

In total, the following Prizes will be given out at the end of the Promotion Period: a Bitpanda Client (as defined in the Bitpanda Group terms and conditions) who buys a Blockpit Licence during the Promotion Period on Bitpanda Broker (not Bitpanda Pro) is eligible to win a Prize of €1,000 worth of BEST. Out of all Participants, 3 (three) will be selected randomly to win this Prize. Winners may not elect to receive a Prize in EUR instead of BEST. Value of BEST Prize determined by Bitpanda’s set rate on a date and time selected by Bitpanda at its discretion prior to upload of Prize to Winner’s Bitpanda wallet.

Only Bitpanda Clients who (i) meet all the requirements described in section 3 and (ii) were not, for whatever reason, disqualified by Bitpanda in accordance with section 4 are eligible to be selected as Winners.

Bitpanda will strive to transfer the Prizes to the respective Winners by the 16th of June, 2023. You acknowledge and agree that said transfer may be delayed and Bitpanda shall not be liable for any losses arising out of or in connection with a late transfer (e.g. losses due to price changes).

Winner Notification

Participants, who are declared Winners in accordance with this section will be notified via email at the email address they have stated in their Bitpanda Client Account with instructions how to claim their Prize. The Prizes will be credited directly to the Winners’ respective Bitpanda Broker wallet. Bitpanda assumes no responsibility for undeliverable emails.

Licences Discounts 

Bitpanda will offer a 25% discount on Blockpit Licences to all Bitpanda broker customers that purchase a licence during the Promotion Period and that meet all the criteria described above in section 3.1 Eligibility.

Special Discounts to BEST VIPs

Bitpanda will offer a 90% discount on Blockpit Licences to all Bitpanda broker customers who are BEST VIP level 5 users. In addition, Bitpanda shall offer a 75% discount on Blockpit Licences to customers who are BEST VIP level 4 users. In addition, Bitpanda shall offer a 50% discount on Blockpit Licences tocustomers who are BEST VIP level 3. Discounts to VIPs will be given on the Start Date of this Promotion.

The aforementioned discounts for Bitpanda BEST VIP levels 3, 4 and 5 will only be applicable for licences purchased during the Promotion Period.

4. Other Important Information

Please note that Blockpit cannot guarantee that its licence is available without any restrictions depending on the Participant's place of residence.

The tax reporting solution is a service provided solely by Blockpit. Bitpanda disclaims any and all liability for such third party services. You are solely responsible for compliance at all times with all domestic and international tax laws resulting from holding, trading and/or exchanging assets with the trading service, so we advise you to consult your own tax and accounting advisors before filing your tax return.

5. Disqualification 

Bitpanda may disqualify a Participant if  there is (i) collusion between Participants aimed at manipulating the Promotion, (ii) a breach of these Terms and Conditions, (iii) a breach of any other applicable terms and conditions of Bitpanda, its subsidiaries or Blockpit, or (iv) if any data provided by you is incorrect.

Disqualified Participants will not be entitled to become a Winner or win any other Prize under this Promotion.

6. The Parties’ responsibilities 

Please note that you are responsible for the correctness of the data provided by you.  

The allocation of the Winners is carried out by an internal procedure of Bitpanda using random selection. Bitpanda will not disclose any information regarding the random selection process.

Participants also acknowledge that the scope of the Blockpit licences and their unlimited availability is not guaranteed by Bitpanda and that the usability of the Blockpit licence may be severely restricted or not available depending on the Participant's place of residence.

7. Data protection

Bitpanda collects your personal data on the basis of your consent in accordance with Article 6 (1) item. a General Data Protection Regulation 2016/679 (“GDPR”) and insofar as this is necessary for the establishment of the legal relationship with the Participant and for the subsequent implementation and handling of the Promotion and Discounts.
