“Bitcoin Pizza Day“ via INSTAGRAM

1. General

The following terms and conditions (“Terms”) govern the rules for participating in the Bitcoin Pizza Day Giveaway (“Giveaway”) held by Bitpanda GmbH, with its corporate seat in Stella-Klein-Löw Weg 17, A-1020 Vienna (“Bitpanda”) and the resulting legal relationship between Bitpanda and participating Instagram users (“Participant” as defined in clause 3 or “you”).

Please be advised, participating in the Giveaway shall constitute your unconditional acceptance to be bound by these Terms. Bitpanda Group TC and  Bitpanda GmbH & BAM Terms and Conditions in their current versions apply.

The English version is a referential translation of the original German version of these Terms.  In the case of any discrepancy, the German version shall prevail. 

By participating in the Giveaway, you represent and warrant you meet the eligibility requirements below and acknowledge that failure to meet all eligibility requirements will result in your disqualification.

2. Duration

This Giveaway begins on 22 May 2024, at the time of publication of the respective Instagram post and ends on 29 May 2024, at 23:59  (CEST) (“Giveaway Period”).

3. Eligibility and Entry

Entry is open to Instagram users (“Participant”) who 

(a) meet all the entry criteria described in these Terms and accept these Terms, 

(b) meet all the requirements described in the respective Instagram post:

• Like the respective post;
• Follow our account @bitpanda; and
• Comment to the respective post: which topping would you like to have on your Pizza?

(c) have reached the minimum participation age of 18 years,

(d) are not resident in a country or territory where the Promotion is not available*, and

(e) are (or become) fully verified and registered Bitpanda Clients.

Each person may only take part in the Giveaway via Instagram once. Multiple entries are not permitted. Bitpanda reserves the right to exclude Participants from the Giveaway in the event of multiple entries.

*Please note that - due to regulatory requirements - Bitpanda Promotions are not available to users in certain restricted jurisdictions (eg. users with residence in Turkey, in the Netherlands, in Belgium and in the UK). This communication is not intended for users/countries where restrictions apply.

The following natural or legal persons are not eligible to enter the Giveaway: 

(a) persons performing market making services or any similar services as well as institutional investors,

(b) Bitpanda Technology Solution users,

(c) employees and the immediate family members of such employees of Bitpanda or its affiliated companies, parent companies, subsidiaries, participating promotional partners, advertising agencies, and any company involved in the creation, production, or fulfilment of the Giveaway.

4. Prize Drawings, Notifying winners and Distribution of the Prize

After the Giveaway Period, certain participants will be selected according to the criteria set out below and will receive a prize. The amount received per Prize will be determined by the market value according to the asset/EUR trading pair on Bitpanda at the time of transfer to the Winners. Please note that in order to receive a prize, a Bitpanda Client account using the email address provided in accordance with the winner's communication is required.

After the Giveaway Period has ended, Bitpanda will randomly choose 10 Participants (“Winner”) that will each receive €100 worth of Bitcoin (“Prize”). 

Only participating Instagram users who (i) meet all the requirements described in section 3 and (ii) were not, for whatever reason, disqualified by Bitpanda in accordance with section 5 are eligible to be selected as Winners.

The winners must have fully verified and registered as a Bitpanda-Client on the Bitpanda system within 5 days after winner notification at the latest.  Prizes will be credited directly to the participant's Bitpanda Broker Wallet within 10 days after the Giveaway Period. Prize distribution may be delayed and Bitpanda is not liable for any losses resulting from or related to delayed distribution.

Participants, who are declared Winners in accordance with this section will be notified via the comment-section under the respective Instagram-post. The winners must respond to this within 24 hours by providing Bitpanda with their contact details for further communication via private Instagram message. In the event a potential Winner cannot be contacted, fails to respond or refuses the Prize, the potential Winner will be disqualified without further notice and an alternative Winner may be selected. Bitpanda assumes no responsibility for undeliverable emails. Potential winners may be subject to verification by Bitpanda.

5. Disqualification 

Bitpanda reserves the right to disqualify a Participant it suspects or finds (i) to have tampered with the entry process or the operation of the Giveaway, (ii) to be acting in collusion with other Participants aimed at manipulating or disrupting the Giveaway, (iii) to be acting in violation of these Terms, (iv) or in breach of any other applicable terms and conditions of Bitpanda, its subsidiaries, or (v) to have provided inaccurate information.

Disqualified Participants will not be entitled to become a Winner or win any other Prize under this Giveaway.

6. Limitation of Liability

To the extent permitted by law, in no event shall Bitpanda be liable for any direct or indirect loss arising out of or in connection with the Giveaway. 

Bitpanda reserves the right, without any prior notice or compensation to you, to suspend, cancel, postpone or modify the Giveaway, at any time, for any reason whatsoever. You do not have any legal claim against Bitpanda arising out of or in connection with this Giveaway.

7. Privacy and Taxes

All data processing at Bitpanda is carried out on the basis of the contractual obligation in accordance with Article 6 Paragraph 1 Letter b of the General Data Protection Regulation 2016/679 (“GDPR”) for the purpose of establishing the legal relationship with the participant and for the subsequent implementation and processing of the Giveaway.

Winners are solely responsible for any/all applicable taxes related to the Prize. Potential Winners should consult a tax advisor to determine tax implications in accepting any Prize.

8.Miscellaneous & Contact

Should individual provisions of these conditions of participation be or become invalid, this shall not affect the validity of the remaining provisions of these conditions of participation. Cash payment of the prize is not possible. Legal recourse is excluded.

The Giveaway is in no way connected to Instagram and is in no way sponsored, supported or organised by Instagram. The recipient of the information provided by the participants is not Instagram, but Bitpanda as the organiser.
