“CryptoHeroes Raffle“

1. General

The following terms and conditions (“Terms”) govern the rules for participating in the CryptoHeroes Raffle (“Raffle”) held by Bitpanda GmbH, with its corporate seat in Stella-Klein-Löw Weg 17, A-1020 Vienna (“Bitpanda”) and the resulting legal relationship between Bitpanda and the Participant (as defined in clause 3 or “you”).

By participating in the Raffle, you confirm and accept these TC and the applicable Bitpanda Group TC and Bitpanda GmbH & BAM Terms and Conditions in their current versions as an integral part of these TC.

Please note that any translation of these TC into other languages shall be deemed as a point of reference and the English version shall prevail in any case.

By participating in the Raffle, you represent and warrant you meet the eligibility requirements below and acknowledge that failure to meet all eligibility requirements will result in your disqualification.

Crypto is volatile. You could sustain a loss of some or all of your investment. Invest only what you can afford to lose. This Raffle does not constitute financial advice or an invitation to conclude a transaction.

2. Duration

This Raffle starts on July 31, 2024, 00:00 (CET) (“Start Date”) and ends on August 21, 2024, 23:59 (CET) (“Closing Date”) (the time in between the “Raffle Period”).

3. Eligibility and Entry

Entry is open to fully verified and registered Bitpanda Clients (“Participant”) who

(a) meet all the requirements described in these Terms,

(b) use the tracking link as provided via the CryptoHeroes social media channel(s) to navigate to the Bitpanda website, place and get a limit order of at least €50 worth of any crypto-asset executed on the Bitpanda Broker during the Raffle Period

Natural or legal persons performing market making services or any similar services are not eligible to enter the Raffle.

Bitpanda Technology Services users are not eligible to participate in the Raffle.

Bitpanda reserves the right to suspend, cancel, postpone or modify the Raffle if it cannot be executed as planned for any reason. You do not have any legal claim against Bitpanda arising out of or in connection with this Raffle.

For the avoidance of doubt, it is hereby expressly emphasised that natural or legal persons who provide market making services or similar services as well as all institutional customers (B2B traders) and market makers are excluded from this Raffle. Any volume generated by the Participant prior to participating in this Raffle will not be taken into account and will not count towards purchase volume calculations. Any purchase volume generated outside of the Bitpanda Broker will not be taken into account. Swapping assets, L-Token and Bitpanda Crypto Indices are excluded from this Raffle.

Please note that while limit orders allow you to specify the maximum price you are willing to pay or the minimum price you are willing to accept, they do not guarantee execution. If the market price does not reach your specified target price, your order may not be filled. Additionally, rapid price movements in the crypto market can cause significant slippage, leading to a different execution price than expected. It is important to understand these risks prior to placing a Bitpanda limit order.

4. Raffle Drawings and Distribution of the Prize

Bitpanda will in the course of the Raffle:

Select the first 100 Participants who met the Eligibility and Entry requirements (“Winner”) that will each receive €10 worth of BTC as a prize (“Prize”);

Only Bitpanda Clients who (i) meet all the requirements described in section 3 and (ii) were not, for whatever reason, disqualified by Bitpanda in accordance with section 6 are eligible to be selected as Winners.

Bitpanda will strive to transfer the Prize to the Winner within 21 days after the end of the Raffle Period. The transfer may be delayed and Bitpanda shall not be liable for any losses arising out of or in connection with a late transfer (e.g. losses due to price changes).

5. Notifying winners

Participants, who are declared Winners in accordance with this section will be notified via email to the email address they have stated in their Bitpanda Client Account with instructions how to claim their Prize. To claim a Prize in this Promotion, Winners must have an active Bitpanda account. The Prizes will be credited directly to the Winners’ respective Bitpanda Broker wallet. Bitpanda assumes no responsibility for undeliverable emails. All potential Winners are subject to verification by Bitpanda.

6. Disqualification

Bitpanda may disqualify a Participant if there is (i) collusion between Participants aimed at manipulating the Raffle, (ii) a breach of these Terms, (iii) a breach of any other applicable terms and conditions of Bitpanda, its subsidiaries, or (iv) if any data provided by you is incorrect.

Disqualified Participants will not be entitled to become a Winner or win any other Prize under this Raffle.

Any attempt by a Participant to deliberately undermine the legitimate operation of this Raffle is a violation of laws, and should such an attempt be made, Bitpanda reserves the right to seek damages from any such Bitpanda Client or individual.

Bitpanda is not responsible for the accuracy of the data you provide and may disqualify a participant if the email address of the Bitpanda Client is not valid.

7. Limitation of Liability

To the extent permitted by law, in no event shall Bitpanda be liable for any direct or indirect loss arising out of or in connection with the Raffle.

8. Privacy and Taxes

The processing of personal data is carried out in accordance with Article 6 Paragraph 1 Letter b of the General Data Protection Regulation 2016/679 (“GDPR”) for the purpose of establishing the legal relationship with the participant and for the subsequent implementation and processing of the Raffle.

Winners are solely responsible for any/all applicable taxes related to the Prize.
