Terms and Conditions
“Bitpanda Spain: Bitcoin 15th Anniversary Raffle”

1. General 

The present conditions (“Terms”) contain the provisions for participation in the “Bitpanda Spain: Bitcoin 15th Anniversary Raffle” (“Promotion”) of Bitpanda GmbH, with registered office in A-1020 Vienna, Stella-Klein-Löw-Weg 17 (“Bitpanda”) and the resulting legal relationship between Bitpanda and the Participant (as defined in Section 3 or “ you ”).

By participating in the Promotion, you agree to these Terms and the applicable Bitpanda Terms and Conditions which form an integral part of these Terms. Please note that the English version is the authoritative version. By participating in the Promotion, you represent and warrant you meet the eligibility requirements below and acknowledge that failure to meet all eligibility requirements will result in your disqualification. 

Investing in crypto carries risks. Conduct your own research before concluding a transaction. 

2. Duration and Prices

This Competition will begin on 9th January, 2024, 00:00 (GMT) and end on the 31st of January, 2024, 23:59 (GMT) (“ Promotion Period ”).

3. Eligibility and Entry: 

Entry is open to fully verified and registered Bitpanda Clients (“Participant”) who

(a) have their country of residence in Spain (participation is limited to users resident in Spain)

(b) meet all the requirements described in these Terms, (c) deposit and buy at least €15 in Bitcoin (BTC) on Bitpanda during the Promotion Period

(d) accept these Terms.

New Bitpanda users will be required to sign up and register, complete the identity verification process  and deposit into a new Bitpanda account in order to participate. 

Natural or legal persons performing market making services or any similar services are not eligible to enter the Promotion. 

White Label users are not eligible to participate in the Promotion. 

Bitpanda reserves the right to suspend, cancel, postpone or modify the Promotion if it cannot be executed as planned for any reason. You do not have any legal claim against Bitpanda arising out of or in connection with this Promotion.Every additional purchase of at least 15 euros of Bitcoin on Bitpanda within the Promotion Period will increase the chances of winning. For clarity, each 15€ purchase of Bitcoin (BTC) counts as one entry. The more 15€ Bitcoin purchases a user makes, the more entries they will receive. There is no limit to the number of entries a user can obtain.

For the avoidance of doubt, it is hereby expressly emphasised that natural or legal persons who provide market making services or similar services as well as all institutional customers (B2B traders) and market makers are excluded from this Promotion. Any volume generated by the Participant prior to participating in this Promotion will not be taken into account and will not count towards trading/purchase volume calculations. Any trading/purchase volume generated outside of the Bitpanda will not be taken into account. In other words, a Participant must buy at least 15€ of Bitcoin (BTC) in Bitpanda during the promotion period in order to receive the Prize (as defined below).

4. Raffle Drawings and Prize

In total, the following Prizes will be given out at the end of the Promotion Period:  One Year of Free Pizza by Grosso Napoletano: One winner will receive a total of 52 vouchers by Grosso Napoletano, each valued at 15€, intended to cover the cost of one pizza per week for a year.

Additional Prizes: Ten (10) additional winners will each receive a single voucher from Grosso Napoletano valued at 15€, intended for the purchase of one pizza.

In total, 11 winners will be randomly selected from all eligible participants. Only Bitpanda Clients who (i) meet all the requirements described in section 3 and (ii) were not, for whatever reason, disqualified by Bitpanda in accordance with section 6 are eligible to be selected as Winners.

Bitpanda will strive to transfer the Prizes to the respective Winners by the 15th of February, 2024. The transfer may be delayed and Bitpanda shall not be liable for any losses arising out of or in connection with a late transfer.

5 Notifying winners 

Participants, who are declared Winners in accordance with this section will be notified via email to the email address they have stated in their Bitpanda Client Account with instructions how to claim their Prize. To claim a Prize in this Promotion, Winners must have an active Bitpanda account. Bitpanda assumes no responsibility for undeliverable emails. All potential Winners are subject to verification by Bitpanda.

6. Disqualification

Bitpanda may disqualify a Participant if there is (i) collusion between Participants aimed at manipulating the Promotion, (ii) a breach of these Terms, (iii) a breach of any other applicable terms and conditions of Bitpanda, its subsidiaries, or (iv) if any data provided by you is incorrect.

Disqualified Participants will not be entitled to become a Winner or win any other Prize under this Promotion.

Any attempt by a Participant to deliberately undermine the legitimate operation of this Promotion is a violation of laws, and should such an attempt be made, Bitpanda reserves the right to seek damages from any such Bitpanda Client or individual. 

Bitpanda is not responsible for the accuracy of the data you provide and may disqualify a participant if the email address of the Bitpanda Client is not valid.

7. Limitation of Liability

To the extent permitted by law, in no event shall Bitpanda be liable for any direct or indirect loss arising out of or in connection with the Promotion.

8. Privacy and Taxes

All data processing at Bitpanda is carried out in accordance with Article 6 Paragraph 1 Letter b of the General Data Protection Regulation 2016/679 (“GDPR”) for the purpose of establishing the legal relationship with the participant and for the subsequent implementation and processing of the giveaway.

Winners are solely responsible for any/all applicable taxes related to the Prize.
