“Bitpanda & Blockpit Licence Giveaway and Airdrop"


1. General

The following terms (“Terms”) govern the rules for participating in the Bitpanda Blockpit licence giveaway (“Giveaway”) and the Bitpanda Airdrop (“Airdrop“), in cooperation with Blockpit, of Bitpanda GmbH, with its registered office in Campus 2, Jakov-Lind-Straße 2, A-1020 Vienna ("Bitpanda") and the resulting legal relationship between Bitpanda and the participant in the Giveaway and/or Airdrop ("Participant").

By participating in the Raffle & Giveaway you confirm and accept these Terms and the applicable terms and conditions of Bitpanda which are an integral part of these Terms.

2. Time period

The Raffle and the Airdrop start on the 6th of May, 2021, 00:00 am (CEST) and ends on the 25th of May, 2021, 11:59 pm (CEST) (“Giveaway and Airdrop Time Period”).

a. Giveaway

Bitpanda will award professional Blockpit licences to all Participants who are BEST VIP level 3 users on the cut-off date of 25.05.2021 (time: 23:59:59). In addition, Bitpanda shall distribute 200 professional Blockpit licences to Participants who are BEST VIP level 2 users according to a random selection method. In addition, Bitpanda shall distribute 50 professional Blockpit licences among the Participants who are BEST VIP level 1 users in accordance with the same random selection procedure. The deadline for determining the BEST VIP level is 25.05.2021 (time: 23:59:59). In addition, Bitpanda will randomly distribute 50 professional Blockpit licences between the remaining Participants (regardless of their BEST VIP level).

Furthermore, the first 100 Participants who (i) register and verify a Bitpanda customer account via Bitpanda Pro for the first time and completely (i.e. exclusively new Bitpanda customers) and (ii) successfully execute at least one trade on Bitpanda Pro (only fully completed and executed trades are valid) during the Giveaway and Airdrop Time Period will receive a professional Blockpit licence. Creating and registering a Bitpanda Pro Business account does not entitle you to participate in the Giveaway.

All Participants who have already received a Blockpit licence from Bitpanda through a previous promotion of this Giveaway are excluded from participating in this Giveaway and cannot be selected by Bitpanda to receive a Blockpit licence.

b. Airdrop

The first 11,000 Participants (the first 10,000 Participants via the Bitpanda Broker and the first 1,000 Participants via Bitpanda Pro) who fully and successfully register with Blockpit for the first time during the Giveaway and Airdrop Time Period using the unique Bitpanda link (available under the "History" menu item on Bitpanda and the "Partners" menu item on Bitpanda Pro) and create their first Blockpit account (hereinafter referred to as "Eligible Participants") will be eligible to receive an Airdrop.

At the end of the Airdrop Time Period, a randomly determined Airdrop amount between EUR 5 and EUR 200, paid out in Bitpanda Ecosystem Token ("BEST"), will be distributed between the Eligible Persons ("Airdrop").

The exact Airdrop amount is determined randomly and credited directly to the beneficiaries in BEST at the end of the Airdrop Time Frame. The euro value in BEST is determined by the market value pursuant to the prices displayed in the Bitpanda system at the time of distribution to the beneficiaries. Bitpanda will aim to complete the withdrawal of the Airdrop in BEST within 14 days after the end of the Airdrop Time Period. It is acknowledged and agreed that said withdrawal may be delayed and Bitpanda shall not be held responsible for any losses that may result from or in connection with a delayed withdrawal (e.g. losses due to price changes). The Airdrop will be credited directly to the beneficiary's Bitpanda BEST wallet.

It is acknowledged and agreed that only Participants who (i) meet all the requirements described in this section, (ii) have executed at least one trade within the last six months (i.e. in the time period between 25.11.2020 to 25.5.2021) (in the event of registration on Blockpit via the Bitpanda Broker Link, the trade must be executed and completed via Bitpanda Broker; in the event of registration on Blockpit via the Bitpanda Pro Link, the trade must be executed and completed via Bitpanda Pro) (iii) reside in Austria, Switzerland, Germany, France or Spain and (iv) have not, for whatever reason, been disqualified by Bitpanda pursuant to section 4, are eligible to be selected as Eligible Participants.

3. Communication, liability & disqualification

Participants who meet the above criteria and/or are randomly selected to receive a professional Blockpit licence will receive access to the respective Blockpit licence within 14 days after the end of the Giveaway and Airdrop Time Period, via email notification to the email address registered with the Bitpanda account.

Participants who have been declared eligible will be notified in writing by email to the email address registered with the Bitpanda account at the end of the Giveaway and Airdrop Time Period.

Participants acknowledge that Bitpanda may amend and/or cancel the Giveaway and/or Airdrop as described herein at its sole discretion at any time and no legal claim shall arise against Bitpanda out of or in connection with this Giveaway and/or Airdrop.

The allocation of the professional Blockpit licences and the Airdrop amount allocated to a beneficiary is carried out by an internal procedure using random selection. Participants have no right or claim against Bitpanda regarding the execution of this procedure or its results.

Participants also acknowledge that the scope of the Blockpit licences and their unlimited availability is not guaranteed by Bitpanda and that the usability of the Blockpit licences may be severely restricted or not available depending on the Participant's place of residence.

4. Disqualification

Participants acknowledge and agree that Bitpanda may, at its sole discretion, exclude a Participant from the Giveaway and/or Airdrop at any time for any reason whatsoever, including but not limited to cases in which Bitpanda suspects any wrongdoing. Participants acknowledge and agree that any violation of these Terms or other Terms of Bitpanda and/or its subsidiaries may lead to disqualification.

Participants who are disqualified hereby acknowledge and agree that they have no claim against Bitpanda, including but not limited to direct or indirect losses incurred in connection with participation in the Giveaway and/or Airdrop.

5. Data protection

All data processing at Bitpanda is carried out in accordance with Article 6 (1) lit. a of the GDPR (General Data Protection Act) and insofar as this is necessary for the establishment of the legal relationship with the participant and for the subsequent implementation and handling of the Giveaway and/or Airdrop.
