“New Year Savings Plan Campaign 2024”

1. General

The following terms and conditions (“Terms”) govern the rules for participating in the  New Year Savings Plan Campaign 2024 (“Raffle”) held by Bitpanda GmbH, with its corporate seat in Stella-Klein-Löw Weg 17, A-1020 Vienna (“Bitpanda”) and the resulting legal relationship between Bitpanda and the Participant (as defined in clause 3 or “you”).

By participating in the Raffle, you confirm and accept these TC and the applicable Bitpanda Group TC and Bitpanda GmbH & BAM Terms and Conditions in its current versions as an integral part of these TC.

Please note that any translation of these TC into other languages shall be deemed as a point of reference and the English version shall prevail in any case.

Bitpanda reserves the right to suspend, cancel, postpone or modify the Promotion if it cannot be executed as planned for any reason. You do not have any legal claim against Bitpanda arising out of or in connection with this Promotion.

2. Raffle Period and Prizes

This Raffle starts on January 8, 2024, 10:00 (CEST) (“Start Date”) and ends on January 28, 2024, 23:59 (CET) (“Closing Date”) (the time in between the “Raffle Period”).

Bitpanda will randomly choose 10 Participants (“Winner”) that will receive a monthly savings plan of €100 in Bitcoin for 12 months as a prize (“Prize”).

3. Eligibility and Entry: 

Entry is open to fully verified and registered Bitpanda Clients (“Participant”) who 

(a) meet all the requirements described in these Terms,

(b) are not resident in a country or territory where the Promotion is not available*

(c) set up new** savings plan of at least €100 in total worth of any cryptocurrency (any crypto asset available on the Bitpanda Broker) on Bitpanda during the Raffle Period. To reach the total amount of € 100, the Participant can choose the amount and frequency, e.g. a monthly plan with € 100 or a bi-weekly plan with € 50 each in the given timeframe. This is only an exemplary composition, other formations are also possible to reach the total amount.

(d) accept these Terms.

*Participants with residence in the Netherlands, Turkey, Belgium and the United Kingdom are not allowed to participate in the Promotion.

** “New” in this regard means that a new savings plan is being drawn up for the first time. This does not include the cancellation of an existing plan and recreation of a new one with the same or substantially the same assets. 

Natural or legal persons performing market-making services or any similar services are not eligible to enter the Raffle.

Bitpanda Technology Services users are not eligible to participate in the Raffle. 

Employees and the immediate family members of such employees of Bitpanda or its affiliated companies, parent companies, subsidiaries, participating promotional partners, advertising agencies, and any company involved in the creation, production, or fulfilment of the Promotion are not eligible.

Any volume generated by the Participant prior to participating in this Raffle will not be taken into account and will not count towards trading/purchase volume calculations. Any trading/purchase volume generated outside of the Bitpanda Broker will not be taken into account. Leverage assets are excluded from this Raffle. 

4. Raffle Drawings, Winner Selection and Notification

Out of all Participants, ten Winners will be randomly drawn to receive the Prize. Bitpanda will credit the Prize by making savings plan available to you on your Bitpanda Account starting as of 15 February 2024, followed by a monthly savings plan allocation for 12 consecutive months (each on the 15th +/- 3 days). Distributing the Prize may be delayed and Bitpanda shall not be liable for any losses arising out of or in connection with a late distribution.

The Prizes will be credited directly to the Participants’ respective Bitpanda Broker wallet. 

Participants, who are declared Winners in accordance with this section will be notified accordingly via email to the email address they have stated in their Bitpanda Client Account. In the event a potential Winner cannot be contacted, fails to respond or refuses the Prize, the potential Winner will be disqualified without further notice and an alternate Winner may be selected. Bitpanda assumes no responsibility for undeliverable emails. All potential Winners are subject to verification by Bitpanda.

5. Disqualification 

Bitpanda may disqualify a Participant from the Raffle if there is (i) a breach of these Terms, (ii) a breach of any other applicable terms and conditions of Bitpanda or (iii) if any data provided by you is incorrect.  

Disqualified Participants will not be entitled to become a Winner. If there is any reason to believe that there has been a breach of these Terms, Bitpanda may, at its sole discretion, reserve the right to exclude you from participating in the Raffle. 

Any attempt by a Participant to deliberately undermine the legitimate operation of this Promotion is a violation of laws, and should such an attempt be made, Bitpanda reserves the right to seek damages from any such Bitpanda Client or individual. 

No substitution or cash equivalent of the Prize, or any portion thereof, is permitted. The value of crypto assets is subject to change, and there can be a substantial risk that it could lose value (potentially all value) as a result of buying, selling, or holding the Prize. 

6. Limitation of Liability

To the extent permitted by law, in no event shall Bitpanda be liable for any direct or indirect loss arising out of or in connection with the Raffle. 

Bitpanda reserves the right to suspend, cancel, postpone or modify the Raffle if it cannot be executed as planned for any reason. You do not have any legal claim against Bitpanda arising out of or in connection with this Raffle.

7. Data protection and Taxes 

Bitpanda collects your personal data on the basis of your consent in accordance with section 6 (1) lit. a General Data Protection Regulation 2016/679 (“GDPR”) and insofar as this is necessary for the establishment of the legal relationship with the Participant and for the subsequent implementation and handling of the Raffle & Cashback.

Winner is solely responsible for any/all applicable taxes related to the Prize.
